U.S. District Judge for the Southern District of New York Colleen McMahon said the termination of the federal grants for the National Endowment for the Humanities (NEH) violated the First and Fifth Amendments of the Constitution. Moreover, McMahon said DOGE officials had no authority to order such grant cuts.
McMahon also wrote that ending the grants based on “Perceived Viewpoint” interpretations was a violation of “Protected Expression”.
She scolded the DOGE-authorized cuts for using computer programs and artificial intelligence to determine what grants to cut, and that DOGE “Blatantly used protected characteristics as criteria for grant termination”, ABC News reported.

Liberal Federal Judge in Washington, D.C. Zia Faruqui has sparked outrage after apologizing to Donald Trump's alleged would-be assassin Cole Tomas Allen for restrictions placed on him behind bars.
“At a minimum, I should be apologizing to him. We are obligated to make sure he’s taken care of. Mr. Allen, I’m sorry that things have not been the way they are supposed to”, the judge said.
“To me, it’s extremely disturbing that he was put in five-point restraints, a person with no criminal history”, Faruqui added. “It’s troubling. I never heard of one Washington, D.C. January 6 pipe bomber defendant who was put in five-point restraints or in a safe cell. If the only way to keep him safe is the most punitive thing, that’s a problem.”
While admonishing prison officials, Judge Faruqui emphasized that Allen is presumed innocent until proven guilty. Yet Allen posted a manifesto admitting to plotting the shooting, and video footage captured the would-be assassin rushing past Secret Service while wielding a shotgun before agents opened fire.
In a troubling development, a terrorist front group that has gained tremendous influence by suing and lobbying to embed Islam in American public institutions has succeeded in getting the nation’s federal prison system to submit to Islamic law.
The case involves the Council on American-Islamic Relations (CAIR), a radical Muslim charity that was named as a co-conspirator in a federal terror-finance case involving the Iran-backed Hamas front group Holy Land Foundation.
A few years ago, a Somali Muslim woman, Muna Mahad Jama, was required to remove her hija - a head scarf used as a symbol of modesty in the Islamic dress code—during booking and official prison identification photos were taken.
Jama was convicted and sentenced to 12 years in federal prison for conspiracy to provide material support to the Somali terrorist group al-Shabaab, which has strong ties to al-Qaeda.
Jama helped operate an online network that raised and disbursed money to al-Shabaab for jihadists plots, military operations and safehouses.
